By Mike Perleberg (Hebron, Ky.) - A local Mexican restaurant is being ordered to serve up $90,000 in unpaid wages to employees. The U.S. Department of Labor’s Wage and Hour Division district office in Louisville says owners of El Mariachi Restaurant in Hebron did not properly pay cooks, dishwashers, and bus boys dating back to 2011. While those employees at the North Bend Road location did receive paychecks, they were not paid for the overtime hours they worked. For some pay periods those employees were not paid minimum wage, according to the department. The federal department filed a complaint against the restaurants owners – Jaime Magana, Abel Leon, and Damian Rodriguez – in January of 2014. On Tuesday, a U.S. District Court judge signed a permanent injunction. In addition to the $90,000 in back wages, the owners have also been ordered to pay liquidated damages to 17 employees and another $18,700 in civil money penalties for repeat and willful violations. The agreement to pay those employees only related to the El Mariachi location in Hebron. According to the department, the owners have agreed to hire a consultant to audit restaurants in Harrison and Lawrenceburg as well as locations in Hamilton, Ohio; Lexington, Kentucky; and Statesboro, Georgia. If more violations are discovered at those locations, the defendants will also have to pay back those wages.
