Judge To Rule Today If White Can Stay In Office

(Indianapolis, Ind.) - A judge will rule today on whether or not Indiana Secretary of State Charlie White can remain in office.

 

Marion Circuit Court Judge Louis Rosenberg made the announcement Tuesday at the end of a hearing and has already ruled White wasn't eligible to be on the ballot in 2010. 

 

The Indiana Attorney General is appealing the judge’s ruling claiming that White should be allowed to remain in office because his candidacy was unanimously upheld by the Indiana Recount Commission.

 

The issue is a charge that White used his ex-wife's address in order to vote while he was living somewhere else. White goes to trial this month on felony charge of Voter Fraud for the incident.

 

Democrats say that means election runner-up Vop Osili should replace White if he either resigns or is convicted in his trial later this month. 

 

Indiana law requires a state officeholder to be removed if they are convicted of a felony. In that case, Governor Mitch Daniels would appoint a replacement.
