By Mike Perleberg Update published Tuesday, October 10 at 10:44 a.m.: New details are emerging after a fight between police and a man allegedly under the influence of drugs in downtown Rising Sun. The Ohio County Sheriff’s Office says the Rising Sun Police Department was called to investigate a male subject screaming from the middle of Main Street at about 3:30 a.m. Monday. A Rising Sun officer arrived and attempted to calm down the subject, identified at Michael Immegart, 26, of Rising Sun. However, Immegart became combative, which led to an Ohio County Sheriff’s deputy coming to assist with the situation. Immegart continued to fight with the two officers after being tased multiple times to no effect, deputies said. Officers from the Aurora Police Department and the Dearborn County Sheriff’s Office responded to assist. Immegart was eventually subdued. Police said he appeared to be under the influence of a controlled substance. With Immegart in custody, another man came out of Immegart’s Main Street residence. While speaking with Joshua Cain, 37, of Lawrenceburg, officers allegedly observed him to be under the influence of a controlled substance as well. Immegart and Cain were both transported to Dearborn County Hospital. As of Tuesday, Michael Immegart remains hospitalized. Cain was treated and then transported to the Dearborn County’s jail. He is currently charged with Possession of Marijuana, Public Intoxication, and Visiting a Common Nuisance. A Rising Sun officer, identified by Rising Sun Chief of Police David Hewitt as Officer Laura Wilhelm, was also treated and released from DCH. A search warrant was executed on Immegart’s residence after illegal drugs were observed around the outside of the residence, said deputies. Inside, officers seized a stash of drugs including LSD, prescription pills, psychedelic mushrooms, large amounts of marijuana, powder substances that need lab tested for identification, multiple pipes and bongs, measuring scales, and packaging materials that are commonly used to sell illegal drugs. The sheriff’s department said Immegart’s brother, Matthew Immegart, 23, of Rising Sun, was released from the scene with charges pending. Original story published Tuesday, October 10 at 7:35 a.m.: (Rising Sun, Ind.) - A Rising Sun Police officer was injured in a scuffle with a suspect early Monday morning. Rising Sun Police Chief David Hewitt says Officer Laura Wilhelm responded to a call about a loud and unruly subject on Main Street. “Officer Wilhelm located the individual who appeared to be impaired, yelling and cursing while walking up and down Main Street. Officer approached the subject and he refused to comply with officer’s orders to produce I.D. as she investigated the call,” said Hewitt. The suspect, whose name has not yet been released, allegedly ran from the officer. Wilhelm gave chase and as she attempted to detain the man, he became violent and threatening toward the officer. Wilhelm deployed her taser, but it had no effect due to the suspect’s level of impairment, according to Hewitt. An Ohio County Sheriff’s deputy and an off-duty Rising Sun officer soon arrived for backup and helped detain the suspect. Wilhelm and the subject were each taken to Dearborn County Hospital for treatment. Wilhelm was treated and released. The suspect was admitted for treatment and observation, Hewitt said. Authorities also executed a search warrant of the suspect’s residence located above a business on Main Street on Monday. Chief Hewitt says multiple charges are pending once the Ohio County Sheriff’s Office completes its investigation. The sheriff's office could release more information as soon as Tuesday. “This was a team effort and RSPD appreciates all the assistance given by all the responding agencies,” said Hewitt.
