Threatening Letter To Lawyer Brings New Charges Against Billy Luke

(Dearborn County, Ind.) - New charges have been filed against a man who has become notorious for making threats of violence against Dearborn County law enforcement. Billy Luke, of Dillsboro, is currently serving a 4 ½ year sentence at the Indiana Department of Corrections prison in Westfield. Luke was convicted of Criminal Mischief (class A misdemeanor) and Invasion of Privacy (class D felony) in two separate jury trials in Dearborn County in 2014. Luke first ran into trouble with the law in 2012 when he was caught flashing employees of a pharmacy next to his home in Dillsboro. After getting out of jail, he began making threats toward the victims, who he was ordered not to have contact with, and the Dillsboro Police Department. The stint in prison may not have taught the 31-year-old his lesson. On October 13, the Dearborn County Sheriff’s Department was alerted to a letter that Luke had written from prison and sent to one of his former defense attorneys, according to a court affidavit. In the letter, Luke allegedly made a series of new threats. In one section of the letter referring to a judge who sentenced him, he stated that he is going to “chop that despicable *****… …in to about 10 pieces and throw her in a dumpster where she belongs,” according to the affidavit. The disturbing letter went on to state that Luke plans to get a Barrette .50 caliber rifle and get a Dillsboro police officer acquainted with it for the pain Luke said the officer has caused for his grandmother. Luke even allegedly threatened the attorney to which he wrote the letter, noting that if he did not get the requested paperwork for post-conviction relief, he would send an “associate” to his home who might brandish a weapon, kidnap him, and take him to his law office to obtain the material. Luke also threatened the attorney to tell the county prosecutor about the threats made in the letter. On October 22, Luke was charged with three new counts of Intimidation, one count a level 5 felony and the other two level 5 felonies. A conviction could extend his stay behind bars. A level 5 felony is punishable by up to six years in prison. A level 6 felony carried a maximum sentence of 2 ½ years. This past February, the Indiana Court of Appeals vacated Luke’s 2014 conviction of Stalking (class C felony), finding that it violated principles of double jeopardy. The Indiana Attorney General’s office sought to appeal that decision to the Indiana Supreme Court, who ultimately declined to take up the case, letting the appellate court’s decision stand. Luke’s successful appeal knocked about four years off of his sentence.
