(Rising Sun, Ind.) – Defense attorneys for free agent NFL player Adam “Pacman” Jones are asking a judge to dismiss inflammatory and offensive language allegedly used by Jones prior to his arrest.

At the same time, prosecutors are asking the judge to keep anybody from commenting publicly about the case.

Jones, 35, was arrested at Rising Star Casino in Rising Sun early in the morning on Wednesday, February 27. Agents came to investigate allegations that he was cheating at a card game by changing his bets after the outcome of games had been determined.

Jones allegedly became verbally combative and disorderly, hitting at least one officer. Some of the statements he allegedly made toward officers included “f*** you,” “I will whoop you’re a**,” and “suck my d***.” He also raised his middle-finger toward the officers.

Last week in court, Jones pleaded not guilty to Intimidation (level 6 felony), Battery on a Public Safety Official (level 6 felony), Cheating at Gambling (level 6 felony), Attempted Theft (class A misdemeanor), Resisting Law Enforcement (class A misdemeanor), Disorderly Conduct (class B misdemeanor), and Public Intoxication (class B misdemeanor).

Jones’ legal counsel, Lawrenceburg defense attorney Delmar Weldon, filed on February 28 a motion to strike inflammatory and offensive language from the probable cause affidavit completed by Indiana Gaming Commission agents for preparation of the charges.

“The words cited has no relevance to any of the charging information and serves no practical legal purpose whatsoever,” wrote Weldon. “The inflammatory and offensive nature of this word is beyond measure and beyond dispute.”

In another February 28 filing, Dearborn-Ohio County Prosecutor Lynn Deddens said there are “hours of video” of Jones cheating and his confrontation with officers.

Deddens has filed a motion asking Judge James D. Humphrey to restrict public comments and public presentation of evidence. Restricting all parties and counsel from making additional public comments on the Jones case will “preserve the integrity and fairness of these proceedings,” she argues.

In the motion, Deddens said Jones’ defense attorney, Delmar Weldon, issued a statement and gave interviews prior to charges being filed and without having access to the videos.

“Further, Attorney Weldon has given on camera interviews to local television stations which have been broadcast and are on their websites, in which he elaborates on these allegations, in a manner which implicitly casts aspersions on the integrity of the Court and the Prosecuting Attorney,” Deddens wrote in the motion.

The prosecutor said Weldon’s statements are materially false and were made with reckless disregard. Deddens accused Weldon of grandstanding or misleading public perception of the truth.

Judge Humphrey has scheduled a hearing on the prosecutor’s and defense’s motions for Thursday, March 21.
