(Boone County, Ky.) - A Boone County judge has refused to dismiss charges against a Union man who is accused of murdering his mother and father.
Michael Moore, 42, has been awaiting trial since his 2009 arrest for the murders of former Union Mayor Warren Moore and his wife Madge. The couple was found shot to death in their Union home in June 2009.
Michael Moore, a former Warren County, Ohio sheriff’s deputy, lived in the home with his parents and he was found suffering from a gunshot to his leg. He told police that an intruder had shot him and his parents, but prosecutors have claimed that Moore shot himself in a cover up attempt.
Moore’s defense attorney had accused the Boone County Commonwealth Attorney of withholding DNA evidence, some of which reportedly show a third unidentified person’s DNA present on the gun used in the murder.
During a court hearing Friday, Boone Circuit Judge Tony Frohlich concluded that no evidence was withheld and that lab reports and notes were properly given to the defense.
Moore's double murder trial is set to begin August 12, more than four years after the murders occurred. Delays in DNA testing of evidence have held the trial back.
