Coin Toss Settles Council Election, But...

image(Walton Ky.) - A coin toss has decided the winner of a dead even tie in a race for Walton City Council, but it may not settle who ultimately takes the seat.

 

Robert McDonald and Olivia Ballou each received 669 votes in their November 6 election bids to fill the sixth and final council position.  Under Kentucky law, a coin toss decides the winner in the event of a tie.

 

The coin flip was performed Tuesday at the Boone County Board of Elections. McDonald called tails. The coin landed heads, giving the victory to Ballou.

 

There’s a new twist, however. Ballou said she is moving out of the city due to her husband getting a new job. Thus, she won’t be able to serve the council term anyways.

 

Now, it will be up to Walton City Council to determine who fills the vacant seat, with McDonald eligible to be selected. That will be done December 10.

 

McDonald had previously said that one vote that probably would have went his way was never cast. His wife meant to vote on Election Day, but never made it to the poll.
