Grand Jury Doesn't Indict Parents For Drowning

(Brookville, Ind.) - Charges will not be filed against the parents of a toddler who drowned in the Whitewater River.

 

Mitchell O’Banion, 17, went kayaking with his parents on the river near the town of Cedar Grove along U.S. 52 last June 1. Their kayak overturned, sending the family into the water.

 

The baby’s parents, Carmen Sickmeier, 34, and Lawrence O’Banion, 33, both of Independence, Kentucky, told investigators they did not secure Mitchell’s life vest properly.

 

The lifejacket was found floating downriver later the next day. Mitchell’s body was not located until four days after he went missing.

 

A Franklin County Grand Jury was convened Monday. The members voted not to issue an indictment calling for neglect charges against the parents.

 

The decision took less than 20 minutes for the grand jury to make, the Richmond Palladium-Item reports.

 

Franklin County Prosecutor Mel Wilhelm had requested the grand jury in August.
