(Brookville, Ind.) - A mother and father whose toddler drowned in the Whitewater River could be charged.

Florence, Kentucky residents Carmen Sickmeier and Lawrence O’Banion were with 17-month-old Mitchell Obanion when he drowned in the river on June 1.

The group’s kayak overturned into the water near the town of Cedar Grove along U.S. 52.

The younger O’Banion’s lifejacket was not properly secured, the parents told authorities. It was found downriver with the child’s body located three days later near New Trenton.

The Franklin County Prosecutor Mel Wilhelm petitioned the Circuit Court judge to convene a grand jury on September 19.

It’s unclear exactly what charges the parents could face.

A Richmond Palladium-Item report says Indiana has no law requiring children of any age to wear a life jacket while in a boat.
