Deputy Mike Fogle
(Lawrenceburg, Ind.) - A Dearborn County Sheriff’s Deputy is asking for a change of venue for his possible trial.
Michael Fogle was indicted April 29 on charges of Forgery, Theft, Attempted Theft, Obsruction of Justice, Official Misconduct and Perjury.
He allegedly turned in time sheets which included hours he had not worked for federally funded overtime.
Fogle’s defense has asked for a change of venue to another court outside of Dearborn County.
In the motion asking for the change, Fogle’s attorney wrote “he is unable to receive a fair trial in Dearborn County because of the following: Public hostility against the Defendant; Public outrage over the charged offense and the fact that Mr. Fogle is a law enforcement officer; extensive news reporting and responses thereto which castigate the Defendant; Speculative opinion as to the personality and character of the accused; Disclosures of likely inadmissible evidence and false information regarding Defendant’s related and unrelated alleged misconduct.”
A decision will be made by Dearborn Superior Court II Judge Sally Blankenship on whether to grant the request.
Fogle bonded out of jail May 2 after pleading not guilty to the charges.
