(Franklin County, Ind.) - The parents of a four-year-old boy who died of a gunshot will not face charges.
Aiden Mehlbauer died after being shot with a handgun that he and his twin brother found loaded in their Metamora home last Wednesday. The gun was stored in an area in the family’s basement where their father, Franklin County Sheriff’s deputy Greg Mehlbauer, was storing his equipment.
Indiana State Police say Franklin County Prosecuting Attorney Mel Wilhelm announced Tuesday morning his office would not seek charges in the accidental death.
“Mr. Wilhelm has carefully reviewed the state police reports and has spoken at length with investigators concerning their findings and feels the circumstances surrounding this incident do not meet the elements of a crime under the Indiana Code,” state police Sgt. Noel Houze said in a release.
Aiden Mehlbauer’s funeral is being held Tuesday morning in at St. Louis Catholic Church in Batesville.
